RE:
Request that the Board reconsider its decision to decline to waive the $720 and $500 campaign finance late fees assessed against Rodney D. Miller, an unsuccessful candidate for Mayor, Town of Livingston (Pop. 1,877), Livingston Parish, in the November 3, 2020 election, whose 30-P and 10-P campaign finance disclosure reports were filed 18 and 13 days late, respectively.
Facts:
Reconsideration states: He didn't receive notice of the original meeting date until after it had passed. He also claims financial hardship.


Original request stated: He thought everything required was sent in a timely manner. He faxed in the first report on October 23rd because when he read the schedule it was his understanding it was due on Oct 26th. He received it back stating it was not correct and by this time the election was almost over. He revised it and faxed it back on Nov 8, 2020. Then, on Nov 11th, he sent in all the final paper work that was not due until Nov 25th, so he is confused about what he has done wrong or what is missing. He had not heard from anyone until he received this letter dated Dec 3, 2020 regarding the late fee assessment. After reviewing the paper work, he did see where he forgot to put an address for a contribution received on Schedule A1, which he corrected.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
Recommendations:
Reduce to $250 each ($500 total) based on financial hardship.
