RE:
Request that the Board waive a $120 campaign finance late fee assessed against Kendrick J. Guidry, successful candidate for District Judge, 14th Judicial District Court, ES 1, Div. H, Calcasieu Parish, in the November 3, 2020 election, whose 30-P campaign finance disclosure report was filed 2 days late.
Facts:
Mr. Guidry requests a waiver and states the following:
He and the committee members were displaced due to the devastation caused by Hurricanes Laura and Delta to Lake Charles and the surrounding areas. The members were unable to properly communicate due to lack of phone, internet and electricity for almost the entire months of September and October. Files were difficult to reconstruct due to the destruction. Unfortunately, some very important matters, like filing deadlines, were impossible to meet. It is their opinion that these reasons are good cause why the report was not filed timely.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(B)(3) provides that a fine may be rescinded if the late filing was due to a natural disaster affecting the person responsible for filing the report within 14 days prior to the report being due.


Recommendations:
Suspend all based on future compliance.
