Advisory Opinion request submitted by Don Chauvin, concerning whether the Louisiana Code of Governmental Ethics ("Code") would prohibit his receipt of a vehicle allowance while he runs for Mayor of Carencro.
Facts:
He is currently employed by the City of Carencro ("Carencro") as the City Manager and is eligible for a vehicle allowance. Additionally, he is a candidate for Carencro Mayor. He has inquired whether the Code:



1. Prohibits him from collecting a vehicle allowance for a personal vehicle, which he primarily uses for city business, if that vehicle displays his campaign window decal?



2. Prohibits him from designating his second personal vehicle as the vehicle to be used primarily for city business and continuing to collect a vehicle allowance?



3. Prohibits him from temporarily using his other personal vehicle, which displays his campaign decal, if the vehicle is designated for city business needs repair?
Law:
La. R.S. 42:1102(2)(a)(vi) For public servants of political subdivisions, "agency" is defined as the agency in which the public servant serves, except that for members of any governing authority and for the elected or appointed chief executive of a governmental entity, it shall mean the governmental entity. Public servants of political subdivisions shall include, but shall not be limited to, elected officials and public employees of municipalities, parishes, and other political subdivisions; sheriffs and their employees; district attorneys and their employees; coroners and their employees; and clerks of court and their employees.



La. R.S. 42:1102(12) defines "Governmental Entity" to mean the state or any political subdivision which employs the public employee or employed the former public employee or to which the elected official is elected, as the case may be.



La. R.S. 42:1111(A) prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt the proposed advisory opinion.
