Advisory Opinion request from Carranza Pryor, Executive Counsel for LSU Health Sciences Center - Shreveport, regarding potential post-employment restrictions for Dr. Christi Rinaudo, Director of Academic Affairs.
Facts:
The LSU Health Sciences Center - Shreveport ("LSUHSC") provides medical education and training at its primary teaching hospitals in Shreveport and Monroe. Dr. Christi Rinaudo is employed by LSUHSC as the Director of Academic Affairs in the Office of Academic Affairs. She reports to Dr. Jennifer Woerner, Associate Dean of Academic Affairs. Dr. Rinaudo's duties include, but are not limited to, coordination and implementation of pre-clinical and clinical curriculum, compliance with accreditation standards, review of all student program evaluations of courses, clerkships, and teaching sessions, work collaboratively with health science partners to create opportunities for interprofessional education, and other tasks as assigned by Dr. Woerner.



In 2018, LSUHSC and Ochsner LSU Health System of North Louisiana ("Ochsner"), a private, nonprofit corporation, entered into a partnership for Ochsner to operate and provide for the day-to-day management of the hospitals and clinics owned by LSUHSC. Ochsner also provides academic training in the medical profession to students outside of LSUHSC, through partnerships with local universities and schools.



Dr. Rinaudo intends to retire in the near future and is considering employment with Ochsner as Manager of Strategic Academic Operations. Her job duties in that role would include coordinating the development of annual goals, maintaining performance metrics, assisting with the preparation and coordination of academic strategic projects, and focusing on support for academic program growth, residency training programs, and associated accreditation initiatives. Dr. Rinaudo stated that her job duties would involve students from institutions outside of LSUHSC and that none of her duties would involve the LSUHSC Dept. of Academic Affairs. She also stated that none of the new job duties would overlap with her current job duties with LSUHSC.
Law:
La. R.S. 42:1121B(1): No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.La. R.S. 42:1102(2)(a) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.

La. R.S. 42:1102(12) defines "governmental entity" to mean the state or any political subdivision which employs the public employee or employed the former public employee.
Recommendations:
Adopt the proposed advisory opinion.
