Waiver request submitted by Crystal D. Younger, Louisiana Licensed Professional Vocational Rehabilitation Counselors Board of Examiners, regarding a $1100 late fee assessed for filing her amended 2019 Tier 2.1 annual pfd 22 days late and a $1500 late fee assessed for filing her amended 2020 Tier 2.1 annual pfd 97 days late.
Facts:
Crystal D. Younger stated she received the notices of her delinquency on 8/26/2021, as she and her family were getting ready to leave under the mandatory evacuation order for Hurricane Ida. (It does not appear that St. Tammany was under a mandatory evacuation order). Her family (husband and son) were displaced and living in a camper in Tioga, Louisiana until October 2022. Her home was heavily affected, as it had 4 feet of water and 2 down trees. On top of Hurricane Ida, she has been struggling to get the boards records in order as the boards administrator quit amid embezzlement allegations. She's had no support or instructions on how to perform her new duties and spent most of her time trying to figure out where and how the money was spent. Then late October 2022, her mother-in-law passed away and then her aunt passed in November 2022. Mrs. Younger stated it's been a struggle and things are just starting to get back to normal. After everything that has happened with the impact of the hurricane, having to pay these fines would be just another devastation that she cannot afford.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
