Waiver request submitted by Amy Leigh Williams Brewer, candidate for Coroner / Grant Parish in the November 3, 2020 election, regarding a $2100 late fee assessed for filing her amended 2019 Tier 2 candidate pfd 21 days late.
Facts:
Amy Brewer contacted the Board of Ethics (BOE) to help her correct the disclosures she submitted. Ms. Brewer stated she did not sign for the certified mail, as it was only placed in their mailbox. Her minor children check the mail while she's at work and places it in a mail basket. Unfortunately, the mail basket may not be reviewed for an extended period of time. Ms. Brewer wanted to serve her community but did not realize the demand of serving as a Coroner would be. She took office the week Covid-19 impacted the parish. She had a very limited supply, no administrative staff, no time to waste, and had no idea what she was doing as she was replacing/finishing Dr. Giror's term (the previous Coroner.) Ms. Brewer stated the position is extremely demanding as she has to work all the cases. Although she has a Deputy Coroner to assist with calls, she performs all the administrative duties since there is no office staff. Her annual salary as an RN is only $35,000,and she only made $7,000 as Coroner her first year and a little over $8,000 her second. She said paying the fine will be a financial hardship as she is a single mother of three and on Medicaid. She does not receive child support or alimony. Ms. Brewer stated these are the events that led to her late filing. She asks the Ethics Board to consider this matter and waive her fine as it would create a great financial hardship.

Law:
La. R.S. 18:1495.7A requires any person who becomes a candidate for an office for which the holder of the office is required to file financial disclosure statements pursuant to R.S. 42:1124, 1124.2, or 1124.3 shall file a financial disclosure statement as required by R.S. 42:1124, 1124.2, or 1124.3 for the office for which he is a candidate. The statement required by this Section shall be filed within three (3) business days after the close of the qualifying period during which the candidate files his notice of candidacy for the office.

La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
