Waiver request submitted by Trevor Troy Land, City of West Monroe Aldermen (Pop. 13,065) / Ouachita Parish, regarding a $2500 late fee assessed for filing his amended 2018 Tier 2 annual pfd 204 days late.
Facts:
Mr. Trevor Troy Land is requesting a waiver for the late filing of his 2018 Amendment. Mr. Land stated he was new to his role as an elected Alderman and did not realize his accountant submitted his Secretary of State and IRS Tax documents in lieu of completing the Tier 2 annual disclosure. He and his family run 4 businesses and were impacted by the Pandemic. They were trying to keep the businesses from closing and all the members had contracted the Coronavirus. His accountant was hospitalized due to Covid and remained in the hospital for a long time, so he had no choice but to try and amend the forms himself. He stated he is not great on the computer, and once he completed the form he mailed them to our PO BOX since he could not locate the physical address to FedEx the documents to the office. Mr. Land said he called each time he received a notice to get a better understanding of what he needed to correct. He apologizes for taking so long to complete his forms and asks the Ethics Board to waive his fine as he was a new alderman. This is Mr. Land's first PFD late fee assessment.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
