Waiver request submitted by Carmen Cetnar, former member of the Developmental Disabilities Council, regarding a $1500 late fee assessed for filing her amended 2019 Tier 2.1 annual pfd 116 days late.
Facts:
Carmen Cetnar stated her husband helps the University of Lafayette (UL) Athletics Department for home games as a hobby. Since the amount he received was small, she did not recall this was reportable income and did not check their tax return, so she accidentally omitted the information. Mrs. Cetnar stated she faxed her amendment around 8/28/2021, from the same fax machine she's used over the past 4 -years to send the annual disclosures. She was surprised to receive the LFO. She can best assume that she accidentally dialed the wrong fax number. Mrs. Cetnar stated she has volunteered a significant amount of time on the Louisiana Developmental Disabilities Council (LADDC) and has advocated for all people with disabilities to have a better life. As a mother of a disabled child, this fine would be a financial hardship as paying this fine would be taking the money used for extra therapies and care for her autistic son. Mrs. Cetnar asks the Ethics Board to have leniency for such a large fine.

Staff Notes: The Disclosure Director requested the IT Department search for a possible missing fax from Mrs. Cetnar. The IT Department search resulted in no successful or failed attempts of any fax(es) during Calendar Year 2021 from the fax number Mrs. Cetnar provided.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
