RE:
PFD Answer filed by members of the Louisiana Military Advisory Council in response to notices of delinquency received requesting they file their 2020 Tier 2.1 PFDs.
Facts:
R.S. 29:61 created the Louisiana Military Advisory Council within the Department of Economic Development. The Louisiana Military Advisory Council was formed to provide a forum for issues concerning the installations and units of the Armed Forces located in Louisiana and the military and retired military personnel and their families who reside in Louisiana. They are responsible for formulating goals and objectives to enhance cooperation, coordination, communication, and understanding among the military, United States Department of Defense, the Louisiana Congressional Delegation, the communities in the state interfacing with the military, and state and local government agencies.

R.S. 29:66 provides that the Council may receive and expend funds made available from any source, including donations or gifts of money or services from public or private organizations, to be utilized for the purpose of the Council. However, according to the members, the Council does not have a budget and it is not given funds to expend, disburse or invest. The Boards and Commissions website provides that the Council does not receive or expend funds.


Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Advise members of the Military Advisory Council that they are not required to file annual personal financial disclosure statements pursuant to R.S. 42:1124.2.1.
