Request for Approval of Disqualification Plan involving Shannon LaFargue, Superintendent of Calcasieu School Board, and his wife, Angela LaFargue, employee in the Accounting and Budget Department.
Facts:
Dr. Shannon LaFargue worked as a student teacher/assistant coach for Calcasieu Parish school system in 1989-1990, as a teacher/coach beginning in 1996, an Assistant Principal in 2007, and as a Principal of a high school in 2014. He became CPSB's Chief Operating Officer in November 2015, and Chief Academic Officer in March 2019. His wife was hired by CPSB in September of 1999.

Shannon P LaFargue, Ph.D. was recently chosen as Superintendent for the Calcasieu Parish school system (CPSB). His spouse, Angela M. LaFargue, has been employed by CPSB for more than one year as an accountant in the School Board's Accounting and Budget Department. She is directly supervised by Dennis Bent, Director of Accounting and Budget. The School Board proposes that the Director of Accounting and Budget continue his supervisory responsibilities regarding Angela LaFargue. As Superintendent, Shannon LaFargue will not participate in any transaction involving Angela LaFargue. To the extent he, in his capacity as Superintendent, would otherwise be involved in any such transaction, those matters will be handled by the Chief Financial Officer, Wilfred Bourne. Insofar as the Superintendent would have responsibility for work hours, absences, work assignments, room assignments, work duties, evaluations, observations, salary, promotion, disciplinary action, and transfer these matters will be handled by Wilfred Bourne, Chief Financial Officer, or by the Director of Accounting and Budget.

Law:
La. R.S. 42:1119C(2) provides that "[t]he provisions of this Section shall not prohibit the continued employment of any public employee nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employees' immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.

La. R.S. 42:1119B(2)(a)(iii) requires that by September 15 each year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement may be assessed a late fee of fifty dollars per day, not to exceed $1,500.


La. R.S. 42:1112B(1) provides that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any of the following persons has a substantial economic interest: (1) Any member of his immediate family.

La. R.S. 42:1112C provides that every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1).

Rule 1402B. Every agency head, upon determining that he may be compelled to participate in a transaction involving the governmental entity in violation of Section 1112 of the Code of Governmental Ethics, shall immediately, and prior to such participation, report the details of the transaction, in writing, to his appointing authority and to the board.


Recommendations:
Approve the proposed disqualification plan.
