Advisory opinion request as to the application of the post-employment restrictions in the Code of Governmental Ethics ("Code") that apply to a former West Feliciana High School Assistant Principal Matt Paxton.
Facts:
Superintendent Milton provided that the School Board has received a grant to provide mental health services for students, and Veritas, a local counseling group, may be selected to provide those services. One of the counselors in the group is former Assistant Principal Matt Paxton. Mr. Paxton was employed with the West Feliciana Parish School District until May of 2021. Mr. Paxton does not own any percentage of the counseling group with which the school system may be contracting, nor did he ever provide any mental health services to the District during his former employment.
Law:
La. R.S. 42:1121B(1): No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt draft advisory opinion.
