Advisory Opinion request regarding a councilmember of Livingston Parish being appointed to an administrative position in the office of the Parish President and the Parish President being appointed to an administrative position of his successor. |

Parish President of Livingston Parish, Layton Ricks, asked the following questions in his request.
1) Is it ethical for a Livingston
Parish councilmember, Jeff Ard, who will not run for reelection at the
expiration of the term, to immediately accept an appointed administrative
position such as Chief of Staff or Chief Executive Assistant with the
Livingston Parish President's Office?
2) Is it ethical for that
councilmember, Jeff Ard, upon completion of the term of office to continue his current full-time employment with a private company, an electrical instrumentation
construction maintenance management and technical group, while working full time
for the Parish of Livingston in an administrative role? If so, would it be
ethical for the private company to pay the salary and benefits to the employee
former councilmember on behalf of the Parish rather than the Parish of
Livingston paying the salary and benefits should the private company offer to
do so in addition to paying the private salary?
3) Is it ethical for a duly elected Parish
President for the Parish of Livingston at the end of his term and with no reelection
bid to immediately accept an appointed position, such as Chief of Staff or
Chief Executive Assistant with the Parish of Livingston in the Administration
of the successor?

La. R.S. 42:1121A(1) provides that no
former agency head or elected official shall, for a period of two years
following the termination of his public service as the head of such agency or
as an elected public official serving in such agency, assist another person,
for compensation, in a transaction, or in an appearance in connection with a
transaction, involving that agency or render any service on a contractual basis
to or for such agency.
La. R.S. 42:1121A (2) provides that no
former member of a board or commission shall, for a period of two years
following the termination of his public service on such board or commission,
contract with, be employed in any capacity by, or be appointed to any position
by that board or commission.
