RE:
Request that the Board waive the $540, $1,140 and $180 campaign finance late fees assessed against Barbara Norton, an unsuccessful candidate for State Representative, 3rd Representative District, Caddo Parish, in the October 12, 2019 election, whose 30-P, 2020 & 2021 supplemental campaign finance disclosure reports were filed 9, 19 and 3 days late, respectively.
Facts:
Representative Barbara Norton requests a waiver and states the following:

30-P: She received a letter dated 4/6/22 informing her of a late fee assessment for the 30-P report which was due 9/12/19. Due to the amount of documentation and information needed to file the report it took much longer than her report preparer thought it would take. She had to research the addresses, dates, telephone numbers and amounts to make sure they were accurate. The process was extremely timely. However the information was reported and filed 9/21/21.


2020 Suppl: She received a letter dated 4/6/22 informing her of a late fee assessment for the 2020 Supplemental Report. She received a letter on or about 3/7/21 stating that her 2020 Supplemental Report needed to be filed no later than 3/29/21. The report was filed 3/9/21 which was prior to the date provided on the letter. She requests a waiver of the $1,140.00 late fee assessment of the 2020 Supplemental Report.


Staff Notes: This letter was the NOD which states that "If your report is not filed by March 10, 2021, additional penalties of up to $10,000 may be imposed by the Board of Ethics after an administrative hearing is conducted."
2021 Suppl: Due to the fact that her term as state representative was over in January 2021, she did not know or become aware until receiving notice that she was required to file this report. Immediately upon notification all necessary documents were gathered and given for the report to be filed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed. 18:1484.(2)(b). Each candidate for any other public office shall file reports of contributions in excess of two hundred dollars in the aggregate during the aggregating period.
