Waiver request submitted by Steven P. Hebert, Louisiana Real Estate Commission / Lafayette Metropolitan Expressway Commission / Lafayette Planning and Zoning Commission, regarding a $1500 late fee assessed for filing his 2019 Tier 2.1 annual pfd 252 days late.
Facts:
Mr. Hebert states that the first he knew that he had failed to file was the late fee letter sent on 2/28/2022. He states he immediately filed the outstanding report. He is asking to have his late fee waived for the following reasons:
1. He rolled off the Louisiana Real Estate Commission in 2019. The Real Estate Commission staff was diligent with reminders of filing the report. He then served on another board, LA Expressway Commission. He states it rarely meets. He did not have any reminder or prompting to file the report.
2. In early 2020 when this report would have been due, he was handling numerous critical responsibilities for his employer, Billeaud Company (owner/operator of office and retail space). This is when the pandemic caused disruption and he was assisting tenants managing shutdowns and insuring safe conditions for properties.
3. He served on just a couple of volunteer commissions.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
