Waiver request submitted by James Wallace Ginn, Jonesboro Board of Alderman (Pop. 4,704) / District A /Jackson Parish, regarding a $1500 late fee assessed for filing his 2019 Tier 3 annual pfd 434 days late.
Facts:
Mr. Ginn stated that he found a copy of his 2019 PFD with the date 6/23 written on it. He stated that an alderman reminded him about the filing requirement at a budget meeting in June, which reminded him that he had not done it yet. He believes he mailed it on 6/23/20 using Stamps.com, which would have a record of printing a label for postage of that letter. He would have used Priority Mail, but he found no such record, so he did not mail it. He states that he has a UPS account, but he can not research tracking numbers or invoices past one calendar year. He is confident he did the report, but cannot prove how he sent it. He resent the report via fax. He states that he sent the original cover sheet, but the report was amended to show additional information on Schedule B. He is asking for a reduction, suspension or waiver of the late fee. He states that he is not a perfect record keeper and, as a first time office holder, the reports are new to him. He states that he is a pretty good record keeper, but did not do the job with this report.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15 th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
