Waiver request submitted by Shelia Glover Bordelon, former Assessor / Lincoln Parish, regarding a $2500 late fee assessed for filing her 2020 Tier 2 annual pfd 232 days late.
Facts:
Ms. Bordelon stated that she retired from the Lincoln Assessor's Office in June 2020 and was under the impression that she was finished with paperwork. She states that she was surprised to receive the NOD that was signed for by the postal worker because of Covid. She states that her days started ticking off when the letter was signed for without her knowledge. She said she asked for an extension since she was heading out of town to a remote location. No extension was granted, but staff member Tammy Frazier was helpful. Ms. Frazier faxed her the form. She states that the lady at her campground in North Arkansas allowed her to use a fax machine, who tried to fax it at least 8 times on August 11th, the deadline date, and kept getting a busy signal. She said she spoke with Ms. Frazier who said there was a phone problem in Baton Rouge and Ms. Frazier suggested that she upload photos of the document. She said she did that several times. She said she called Ms. Frazier asking if her information had been received, at which time Ms. Fazier told her that uploading from her iphone would not work, but she would check with IT to see if they could locate her information. She states that since she never heard back, she assumed it had been received. She states that she has always filed her paperwork timely.

STAFF NOTES: Ms. Bordelon called on August 9, 2021 hoping for an extension. Ms. Frazier explained that it was due by August 11th and offered to fax the form to her at the campground. Ms. Bordelon told Ms. Frazier that she found the notice in her mailbox on August 7th on her way out of town. Ms. Bordelon called late on August 11th saying she tried to fax it but it kept saying "long distance circuits were busy." Ms. Bordelon called in the morning on August 12th letting Ms. Frazier know it was uploaded yesterday, but Ms. Frazier did not see it. IT was able to see that there were 3 attempts to fax and to upload - all on August 11th. Ms. Frazier gave Ms. Bordelon her email address to email the images of the form. Ms. Frazier said she would let Ms. Bordelon know when she had the printed copies in her hand. Ms. Frazier never received the email.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
