Waiver request submitted by Allison Berger Tiller, former member of the Downtown Development District, regarding a $1500 late fee assessed for failing to file her 2019 Tier 2.1 annual pfd and a $1500 late fee assessed for failing to file her 2020 Tier 2.1 annual pfd.
Facts:
Ms. Tiller states that at the end of 2019 she discussed her change in schedule/jobs that resulted in her inability to attend most meetings of the Downtown Development District (DDD). At that time, she was asked to stay on the commission. However, by May of 2020, she states that she was asked to resign by the Mayor's office for her failure to attend meetings. She states that this all occurred at the height of the pandemic when she was attempting to home school her 3 children (kindergarten, first, and third graders). She stated they all have learning differences, as does she. She also stated that her dog died during this time and she sank into a deep depression. She stated that she did not have the capacity to deal with anything other than what she was immediately facing day to day. She stated that because she was no longer on the DDD, she was out of the loop for the filing deadlines. She stated that she takes full responsibility for failing to file, but thinks the late fees are very steep for giving her time of 8 years to the DDD. She states that the late fees are a deterrent to anyone who wants to give back to their community with no expectation of a personal benefit. She states that she will pay the 2018 late fee for failure to sign the disclosure, as that was her responsibility while she was still serving on the DDD.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
