RE:
Request for the approval of a disqualification plan involving the Human Resources Manager of Louisiana Department of Veterans Affairs (LDVA) and her husband, a horticultural attendant for the Southeast Louisiana Veterans Cemetery (SELVC).
Facts:
The Louisiana Department of Veterans Affairs (LDVA) is headquartered in Baton Rouge and operates five veterans cemeteries across the state including the Southeast Louisiana Veterans Cemetery (SELVC). SELVC has recently hired Calvin Brumfield as a horticultural attendant. He is scheduled to begin work on September 19, 2022 and will be directly supervised by Daniele Palen, the director of SELVC. Mr Brumfield's wife, Sycondria Wilson, has been employed as the Human Resources Manager at LDVA headquarters since December 2019. Her duties do not include management or supervision of any employees at SELVC but do include review of time entries and payroll. To avoid any potential violation of La R S 42:1112, LDVA has approved and implemented the following disqualification plan. Ms. Wilson is prohibited from participating in any decisions addressing leave requests, approvals, performance evaluations, disciplinary actions, pay increases, promotions, demotions, or in any other activity in which Mr. Brumfield may have a substantial economic interest. Any decisions or activity regarding Mr. Brumfield that are normally performed by Ms. Wilson will either be performed by Dustin Guy, LDVA Deputy Chief of Staff or an individual appointed by Mr. Guy. LDVA respectfully requests that the Board of Ethics approve this plan.
Law:
La. R.S. 42:1112B(1) provides that no public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any of the following persons has a substantial economic interest: (1) Any member of his immediate family.

La. R.S. 42:1112C. Every public employee, excluding an appointed member of any board or commission, shall disqualify himself from participating in a transaction involving the governmental entity when a violation of this Part would result. The procedures for such disqualification shall be established by regulations issued pursuant to R.S. 42:1134(A)(1).

Recommendations:
Adopt the proposed advisory opinion.
