Waiver request submitted by Terrica Williams, Baton Rouge City Constable / City Court / East Baton Rouge Parish, regarding a $800 late fee assessed for filing her 2020 Tier 2 annual pfd 8 days late and a $100 late fee assessed for filing her amended 2020 Tier 2 annual pfd 1 days late.
Facts:
Ms. Williams states that she tries really hard to keep up with and respond to all requests. She says she was diagnosed with Covid in August 2021 and was down for several weeks. She says she remembers receiving a notice in November 2021, calling in and providing everything to get that taken care of. She says that she received notice that all was corrected. She says she did not realize it was 2 different reports. She says that she received a notice dated March 4, 2022 called Notice of Delinquency -Amend. That notice stated she had 7 business days to file an amendment. She says that she called in and was told it was on the wrong form. She corrected it and faxed it. She says that even with her busy schedule, she tries to take the time and stay on top of her ethics reports/filings. She humbly asks for a waiver with the understanding that this is her first time and plans to not let this happen again.

STAFF NOTES: Staff spoke with Ms. Williams on September 27, 2021 about the failure to file the 2020 PFDs. Ms. Williams told staff that she filed it before she spoke with another staff member about her 2019 report and amendment (Ms. Williams received notices about these reports and timely filed that information). Ms. Williams told staff she would find her copy and fax it. Staff checked and the 2020 report was not filed with the 2019 report and amendment. Ms. Williams called on March 11, 2022 about the NOD -Amend, and staff explained again the reporting requirement. Ms. Williams stated she would sent it in by Monday (March 14, 2022). She filed on March 16, 2022.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
2020 Annual - suspend all based on future compliance with the Code of Ethics


2020 Amendment - decline to waive
