RE:
Request that the Board waive the $3,000 campaign finance late fee assessed against Community Organization for Urban Politics, a political action committee, its committee's chairperson, and treasurer, Lambert Boissiere, Jr., in the November 13, 2021 election, whose 10-P campaign finance disclosure report was filed 33 days late.
Facts:
Lambert C. Boissiere, Jr., chairperson and treasurer, for PAC request a waiver and states the following:


As told by the office 2 years ago, the only report that was absolutely required was the 10-G report as the instructions on the calendar schedule are printed in bold letters stating exactly that. He was told that the 10-G report was required regardless of funds expended and/or collected as the calendar indicates. It was his understanding that the 10-P as well as other reports were not required if there was zero activity. They have filed all reports this year on time and will file all reports required in the future.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $2,000 based on Rule 1205C; decline to waive.
