Waiver request submitted by Gary Smith, Sr., regarding a $700, $800, $400 and $100 late fees assessed for the late filing of four initial Disaster Contract Disclosures pursuant to R.S. 42:1114.3.
Facts:
On August 29, 2021, Hurricane Ida devastated parts of South Louisiana, including Mr. Smith's businesses and personal property together with the property of his employees. His business did enter into contracts for relief work, but he was not part of those discussions or contracts. He was the lead for the recovery efforts involving their marine operations. He states his new assistant, who started her employment on August 20, 2021, was not aware of the filing deadline for the initial contract disclosure statements. He states he was not actively participating in the company that handled these contracts.
Law:
La. R.S. 42:1114.3B provides that each elected official, each appointed state official, and each immediate family member of an official subject to this Subsection or Subsection A of this Section who derives, either directly or through a legal entity in which such official or immediate family member owns ten percent or more, any thing of economic value through any contract which is related to a gubernatorially declared disaster or emergency and which the official or immediate family member knows or should reasonably should know is or may be funded or reimbursed in whole or in part with federal funds shall disclose the information required by this Section.
Recommendations:
Waive the late fees.
