Waiver request submitted by Ralph Keith Broussard, a former member of the Opelousas Downtown Development District, regarding a $1100 late fee assessed for filing his amended 2019 Tier 2.1 annual pfd 22 days late.
Facts:
Ralph Broussard states that he did receive the NOD-Amend letter and completed the enclosed amendment form. However, he failed to mail the item in time. Mr. Broussard is the Fund and Executive Director of Magnolia CDC, a nonprofit organization. During the time when the amendment was due, he was heavily involved with Magnolia CDC's first 4-unit single-family housing development located in a rural area of Louisiana. This project, along with his end-of-year annual program of elderly housing rehabilitation consumed much of his time. Mr. Broussard stated he understands that his negligence is not a reason for failing to file timely, but he would appreciate any consideration form the Ethics Board on his matter. Mr. Broussard was appointed to the Opelousas Downtown Development District as the board's Secretary/Treasurer in January 2019. He filed an initial PFD when completing his appointment questionnaire.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
