Waiver request submitted by Valerie Gotch Garrett, former member of the Lafayette Airport Commission, regarding a $1500 late fee assessed for filing her 2019 Tier 2.1 annual pfd 321 days late.
Facts:
Valerie Gotch Garrett submitted a waiver request stating she served on the Lafayette Airport Commission for 12 years and never missed filing or filed a late annual disclosure. Mrs. Garrett's term ended in October 2019, and she did not realize she was required to submit a final report. She contacted the BOE and learned that her notice was issued during Covid and signed by a USPS mail carrier. Mrs. Garrett stated she is the sole caregiver of twin boys that are autistic and her elderly mother, who was hospitalized during this time. After receiving the LFO she tried to recreate a timeline of events to see how she missed filing the final report. Mrs. Garrett recalled receiving a call from "Vanessa in her office" about the NOD-FF letter. On March 25, 2021, Mrs. Vanessa called the BOE and spoke to the Compliance Officer that issued the notice. Mrs. Garrett said she had a total knee replacement, and all those documents are stored away. Unfortunately, her staff has retired. She is physically unable to search for the disclosure completed after the March 25, 2021 call to the BOE.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
