Waiver request submitted by Claudia Ann Cavallino, DDS, State Board of Dentistry, regarding a $1500 late fee assessed for filing her amended 2019 Tier 2.1 annual pfd 46 days late.
Facts:
Dr. Claudia Cavallino stated she has served on the LA State Board of Dentistry for over nine years and has never filed an untimely disclosure. Dr. Cavalliono said her income from the LSBD has been sporadic and very minimal, so she mistakenly forgot to disclose the $450 on the initial disclosure. Dr. Cavalliono stated she lives in a 42-unit condominium in New Orleans; the only mail delivered to the home address is junk mail, catalogs or packages. Her personal and professional mail is sent to her office, so she doesn't check her mailbox office. She stated when mail is delivered to her condo, the building security working that day will sign for any letters and place the mail in the addressee's mail slot. The security guard does not notify the tenants if certified mail is received, only if large packages are delivered. She does not know which guard signed the notice but has started checking her mail more often since this incident. Dr. Cavallino stated once she had the notice in her hand she contacted the BOE the same day and amended the form. She "humbly and respectfully," asked the Ethics Board to consider waiving her fine as she did not intentionally delay her response time.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
