Untimely request that the Board waive three (3) $2,000 campaign finance late fees for a total of $6,000 assessed against Jamar Gailes, an unsuccessful candidate for Mayor, City of Alexandria (Pop. 47,723), Rapides Parish, in the November 4, 2014 election, whose 2016, 2017 & 2018 Supplemental campaign finance disclosure reports were filed 1652, 1287 & 922 days late, respectively.
Facts:
Jamar Gailes requests a waiver and states the following:




Shortly after the election, the campaign team disbanded and everyone got on with their lives. The person who handled all of his financing and reporting thereof not only disbanded, but relocated.

Mr. Gailes returned to the federal system and redeployed on Active Duty to Afghanistan and Iraq and subsequently accepted his final duty station at the Pentagon, Washington DC where he retired in June of 2019. His wife took ill after the campaign and her condition gradually worsened. After his retirement, he was able to return home, to take care of both his wife and son, who battles the same condition. Unfortunately, she passed on April 1, 2020 at the age of 43. He has been looking for that old served paperwork since he found out about her being served many years back, but to no avail.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Consider untimely request. Reduce each to $1,000 ($3,000 total) based on Rule 1205C; decline to waive.
