RE:
Request that the Board waive a $60 and a $2,000 campaign finance late fee assessed against Stephen Petit, an unsuccessful candidate for Judge, 1st Parish Court, Division B, Jefferson Parish, in the November 4, 2014 election, whose 2017 and 2018 supplemental campaign finance disclosure reports were filed 1 and 203 days late, respectively.
Facts:


Stephen M. Petit, Jr., states the following:
As can be seen by viewing any reporting history, his campaign finance reports were initially completed by Dona Gordon, who he hired during his campaign. She filed his reports every year after to satisfy the annual reporting requirements. She filed the 2017 report on February 16, 2018, one day late. For some reason she didn't file the 2018 supplemental report. He was unaware of that fact until contacted by Ethics staff. He immediately filed the report . Also, he would like to point out that since the race, he has not received any contributions nor expenditures. His supplemental reporting is solely to memorialize the loans he made to himself and the very off chance that he will ever run for office again. He would also like to say that since he has taken over the reporting requirements, all supplemental reports have been timely filed.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
With respect to SUPP2017, decline to waive.

With respect to SUPP2018, reduce to $600 based on Rule 1205C; decline to waive.
