Advisory Opinion request from Alan Karr, former employee of the La. Department of Environmental Quality, regarding post-employment restrictions.
Facts:
Alan Karr was employed as a Senior Environmental Specialist in the Remediation Division of DEQ. Mr. Karr coordinated the Resource Conservation and Recovery Act Corrective Action Program, as well as handled work plans, budget projections, and reporting for various programs within his division, such as PPG, Superfund, Brownfields, DSMOA, and LUST. Mr. Karr did not supervise any DEQ employees. He reported to Remediation Division Administrator Estuardo Silva.

Mr. Karr retired from DEQ on January 3, 2023. He intends to market himself to local banks, title companies, or environmental entities to research property histories using the publicly available DEQ Electronic Data Management System, as well as local clerks of courts and property records.
Law:
La. R.S. 42:1121(B)(1): No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1102(18) defines "public employee" to include any person who is engaged in the performance of a governmental entity or is under the supervision or authority of an elected official or another employee of the governmental entity.

La. R.S. 42:1102(2)(a)(i) defines "agency" for public servants in one of the twenty principal departments of the executive branch of state government to be the office in which such public servant carries out her primary responsibilities.

La. R.S. 42:1102(12) defines "governmental entity" to mean the State of Louisiana.
Recommendations:
Adopt the proposed advisory opinion.
