Request to approve an amended disqualification plan for Staci Hoyt and Paige Paxton, employees of the Department of Public Safety and Corrections, Office of Motor Vehicles.
Facts:
PRIOR ADVISORY OPINION:
In Docket No. 2016-535, the Board approved a disqualification plan for Staci Hoyt and Paige Paxton, sisters who are both employed by the OMV. At that time, Staci Hoyt was employed as Deputy Commissioner of OMV, while her sister, Paige Paxton was employed in the OMV Driver Management Section. The disqualification plan designated Karen St. Germain, as OMV Commissioner, to handle all duties, decisions, and approvals regarding the employment of Paige Paxton.

UPDATED INFORMATION:
On June 9, 2022, Paige Paxton's title was changed to OMV Adminstrator - Field Services South. As such, Ms. Paxton would be under the supervision of her sister, Staci Hoyt, as OMV Deputy Commissioner. However, OMV has proposed that Karen St. Germain will continue to supervise all aspects of the employment of Paige Paxton to avoid a potential violation of La. R.S. 42:1112(B)(1).
Law:
La. R.S. 42:1112(B)(1) prohibits a public servant from participating in any transaction in which her immediate family member has a substantial economic interest.

La. R.S. 42:1112(C) allows a disqualification plan to be developed in accordance with rules of the Board to remove a potential violation of Section 1112.


La. R.S. 42:1102(13) defines "immediate family member" to include a public servant's sibling.

Recommendations:
Approve the updated disqualification plan.
