Advisory Opinion request regarding whether Patsy Jarreau can
contract with the Louisiana Board of Medical Examiners after retirement from
the LSU Health Sciences Center. |

Patsy Jarreau is a faculty member of LSU Health Science Center ("LSUHSC"). She currently serves as an Associate Professor and Program Director for the
Department of Medical Laboratory Science. Ms. Jarreau works under Joanie Brocato, Department
Head for the Department of Medical Laboratory Science, and she does not supervise
anyone in the department. As Program Director, her duties include guiding students
through applications for national certification examination and state
licensure. She plans on retiring from LSUHSC in October of 2023.
In 2010, Ms. Jarreau began providing services on a per hour basis as the Associate Director
for Licensure of Clinical Laboratory Personnel to the Louisiana State Board of Medical Examiners ("LSBME") through a contract
between LSUHSC and the LSBME. She reviewed licensure applications for all
licenses and permits granted by the LSBME and provided professional opinions on
questions regarding Clinical Laboratory Personnel presented to the LSBME by hospital
labs, reference labs, physician's office labs, and individuals. She also
organized materials for the Clinical Laboratory Personnel Advisory Committee.
After retirement, Ms. Jarreau plans to provide the following
services to the LSBME on a contractual basis:
1.
Increase in time and effort spent on licensure applications and consultation
about licensure;
2.
Increased presence at the Board office;
3.
Assist in management of licensure analysts;
4.
Increased involvement and interaction with Executive Director and Members
of the Board;
5.
Work with IT Department on layout of applications, and information
included on the website about each licensee;
6.
Work with Executive Director and Attorneys in maintaining in house
policies and procedures in accordance with the law; and
7.
Plan and organize materials for Clinical Laboratory Personnel Advisory
Committee.
Ms. Jarreau asks whether she can contract on an hourly basis with
the LSBME after retirement from LSUHSC.
LSUHSC will no longer have a contact with LSBME to provide an Associate Director of Licensure of Clinical Laboratory Personnel after Ms. Jarreau retires.

La. R.S. 42:1121B(1) provides that no
former public employee shall, for a period of two years following the
termination of his public employment, assist another person, for compensation,
in a transaction, or in an appearance in connection with a transaction in which
such former public employee participated at any time during his public
employment and involving the governmental entity by which he was formerly
employed, or for a period of two years following termination of his public
employment, render, any service which such former public employee had rendered
to the agency during the term of his public employment on a contractual basis,
regardless of the parties to the contract, to, for, or on behalf of the agency
with which he was formerly employed.
