Request to reconsider the Board's decision to decline to waive two $2500 late fees assessed against Charles Broussard, former member of the Acadia Parish Police Jury / District 3, for filing his 2018 Tier 2 annual pfd 491 days late and for filing his 2019 Tier 2 annual pfd 257 days late.
Facts:
Mr. Broussard states his confusion started when he was elected and did not know his district's population (Pop. 7300) met the disclosure requirements. He has incurred over $10,000 in late fees due to his lack of understanding. He is currently living on a fixed income, Covid-19 has impacted his job and paying this late fee would create a financial hardship.

Reconsideration: Mr. Broussard states that he was still confused about the filing requirements even after getting help from staff. He states he has already paid over $10,000 in late fees, lives on a fixed income and paying these fees creates a financial hardship.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
