Waiver request submitted by Ned Anthony Pitre, a member of the Employees Retirement System of Jefferson Parish, regarding a $1500 late fee assessed for filing his 2020 Tier 2.1 annual pfd 48 days late.
Facts:
Ned Pitre states he originally submitted a waiver on February 8, 2022, but did not provide the additional documentation. Mr. Pitre submitted verification that he broke both of his arms on separate occasions in 2021, which left him disabled. (A waiver request dated February 8, 2022 was attached, as well as a letter from a doctor about his left and right fractured humerus.) He states his home, which was in Galliano, was destroyed by Hurricane Ida. He states his mother passed in November 2021 and he is his 98 year old dad's live-in caregiver. Since the hurricane, they have not gotten cable, internet, or reliable cell-service in his area. Mr. Pitre did submit a check for the penalty, but hopes the waiver with additional information would warrant a return of the fee. He states he is incapable of handling all of the demands life has placed on him at this time. He asked for mercy noting his various hardships. His hurricane damages were not covered by insurance, nor has he received any governmental assistance.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
