Waiver request submitted by Darlene Lirette Cheramie, Lafourche Constable, 4th Justice of the Peace Court, regarding a $2500 late fee assessed for filing her 2020 Tier 2 annual pfd 183 days late.
Facts:
Darlene Chermaie stated that when she took office in January 2021, she was unaware of the filing requirements as an elected official. She recalled receiving the Notice of Delinquency-Failure to File and completing her disclosure at the time. She placed it in the email, but the Board of Ethics never received the form. Mrs. Cheramie stated her husband and brother passed away in 2017, 9 days apart from each other, leaving her all alone and devastated. In 2021, she was impacted by Hurricane IDA, left alone - and devastated again. She hired a carpenter, but the company "ripped" her off as they took her money and did not repair the damage to her home. Then, on July 28, 2022, she had triple-bypass surgery. Mrs. Cheramie stated she cannot afford to pay the $2500 fine, and asks the Ethics Board to waive her fine.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
