Waiver request submitted by Donald Paul Schwab Sr., a former member of the Bayou Lafourche Fresh Water District, regarding a $1500 late fee assessed for filing his 2020 Tier 2.1 annual pfd 47 days late.
Facts:
Nancy Schwab is submitting a waiver request on behalf of of her husband, Donald Paul Schwab, Sr. At the beginning of 2020, Mr. Schwab was under a doctor's care for the onset of dementia. Mr. Schwab was also under medical care for several other health issues including a knee replacement, a pacemaker, cancer removal, cellulitis, blood infection, and extensive outpatient physical therapy for his knee. Mrs. Schwab is his main caretaker. The following year was also challenging for Mrs. Schwab. She underwent treatment for breast cancer and removal of basal cell cancer. They were impacted by Hurricane Ida in 2022, adding household burdens to their to their medical issues.



Due to his medical issues, Mr. Schwab resigned at the beginning of this year. Mrs. Schwab understands the importance of submitting the disclosures and hopes the late fee would be waived based on his medical conditions. Mrs. Schwab stated paying the fine would be a major financial strain on their already fixed income. They are willing to provide supporting documents to support his claim.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
