Waiver request submitted by Stanley Paul Brien, a member of the Lakefront Management Authority, Orleans Parish, regarding a $1100 late fee assessed for filing his 2020 Tier 2.1 annual pfd 22 days late.
Facts:
Stanley P. Brien stated that his disclosure was due during the height of the COVID-19 Pandemic. At that time, he was finalizing his father's estate. Also, he was handling a the affairs of his 88-year-old-mother, for whom he has Power of Attorney and lives in an assisted living facility, while also dealing with both his wife's and adult son's health issues. Mr. Brien stated it was a very stressful time for him and his family, and he was overwhelmed and simply forgot to file the 2020 PFD. Mr. Brien stated he has served for 12 years as a public servant and has complied with all Ethics filing requirements faithfully. He humbly requests the Ethics Board to consider waiving the fine associated with his unintentional delinquency.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
