Waiver request submitted by Afranie Adomako, a former member of the Firefighters Retirement Board, Louisiana State Employee Retirement System (LASERS), Louisiana Transportation Authority, and Tobacco Settlement Financing Corporation Board, regarding a $1500 late fee assessed for filing his 2020 Tier 2.1 annual pfd 75 days late.
Facts:
Afranie Adomako stated that on August 14, 2020, he retired from state government due to the prolonged illness of his wife and health issues he experienced after contracting the Coronavirus and developing Pneumonia in both lungs in July 2020. From December 2021 to January 2022, it was a hectic time in his household as he and his family were planning a trip to visit his 92-year-old mother, in Ghana, Africa. He does not recall receiving the NOD-FF that was delivered on January 8, 2022, since they were preparing for the trip. In preparation, they were ensuring their passports were valid, obtaining visas, following Covid-19 vaccination protocols, and getting the PCR test to ensure they could board their flights and pass Ghana's Covid-19 mandates to enter the country. The trip was from January 29, 2022, until March 4, 2022. Once they returned home, it took a long time to sort through the mail. When he read the Notice of Delinquency-Failure to File, he called the Board of Ethics and filed the missing report. Mr. Adomako stated due to these circumstances he was unable to timely file his final PFD. His late filing was unintentional and he respectfully and humbly asks the Ethics Board to waive his fine.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
