Waiver request submitted by LaShaunda Pickett-Rene, New Harmony High Charter School, regarding a $1500 late fee assessed for filing her 2018 Tier 3 annual pfd 288 days late.
Facts:
Mrs. Rene stated in April 2019, she moved to 3101 Milan Street in New Orleans, but the Notice of Delinquency (NOD-FF) was mailed to her old address at 5619 Chamberlain, so she never received the NOD-FF. Unforeseen circumstances forced her family to move several more times. In 2020, due to an increase in rent, she was unable to renew the lease on Milan Street. In August 2021, the home they rented was damaged by Hurricane Ida. They evacuated to Florida until October 2021. Then she secured their current home at 1003 N Dorgenois. These circumstances caused a disruption in her mail delivery. Mrs. Rene claimed she was unaware of the delinquencies until she was contacted by the AG's Office. Had she received any of the notices she would have immediately complied.

**Staff Notes: New Harmony High Board President, Kelly Ransom, submitted supporting information on behalf of Mrs. Pickett-Rene. Ms. Ransom stated on October 18, 2019, she was notified by the La. Department of Education of outstanding PFDs for their board members. She then submitted the outstanding PFDs to the Department of Education not realizing the form for 2018 and 2019 were being sent to the wrong agency.

*Mrs. Rene moved in April 2019. Per the USPS Tracking Printout, her 2018 NOD-FF, delinquency notice was forwarded to her new address on July 20, 2019. JSRene signed the NOD-FF green card. On all of her filed PFDs, Jean-Sebastien Rene is listed as her spouse. The initials JSRene are also the initials on the Late Fee Order green card as the person accepting the letter. Although the green card does not have the forwarded address listed by the post office, the item had to be forwarded to the new address in order for the initials JSRene to appear. The Demand Letter was issued on May 1, 2020. She filed her 2018 PFD on May 13, 2020. However, no action was taken to contact the Board of Ethics until she was contacted by the AG in September 2022.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Decline to consider the untimely waiver request.
