Waiver request submitted by Kanisha "Pumpie" Potier, Parks Board of Alderman (Pop. 640), St. Martin Parish, regarding a $500 late fee assessed for filing her 2020 Tier 3 annual pfd 49 days late.
Facts:
Kanisha Potier stated she timely filed her disclosures in the past, but 2020-2021 was "a crazy year for most of us due to COVID-19." She stated that she did not deliberately fail to file the forms. She was a full-time healthcare worker during COVID-19 and is a single mother. She underwent a life-changing experience with her mother becoming unexpectedly ill. Her mother's mental health illness has caused added stress to Ms. Potier's life. She is her mother's primary caregiver - physically and financially. The added stress factors are what she feels led to the untimely filing. She received her NOD on November 8, 2021 and stated she faxed the report on November 16, 2021. On January 6, 2022, she decided to call to confirm receipt and learned that her fax was unsuccessful and did not go through, so she resubmitted it. She plans to take the proper measures to ensure her documents are submitted timely. Ms. Potier would appreciate the Ethics Board waive her fine, as it would create a financial hardship for her now that she is handling the responsibility of her mother's household and medical expenses and her family's basic needs.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
