Advisory Opinion request regarding Ronnie Dees, former member of the Board of Aldermen for the City of Springhill, rendering towing services to the Springhill Police Department.
Facts:
Ronnie Dees was an elected member of the Springhill Board of Aldermen until his retirement on December 31, 2022. Mr. Dees owns a wrecker service and plans to do business in the City of Springhill. Currently, there are no wrecker services in close proximity to Springhill. As such, he asks whether the Springhill Police Department, which is under the supervision of elected Police Chief Will Lynd, can transact with Mr. Dees to perform towing services.
Law:
La. R.S. 42:1121(A)(1): No former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.

La. R.S. 42:1102(3) defines "agency head" to include a member of a board or commission who exercises supervision over the agency.

La. R.S. 42:1102(2)(a)(vi) defines "agency" for public servants of political subdivisions to mean the agency in which the public servant serves, except that for members of any governing authority, it shall mean the governmental entity.

La. R.S. 42:1102(12) defines "governmental entity" to mean any political subdivision to which the elected official is elected.
Recommendations:
Adopt the proposed advisory opinion.
