RE:
Request that the Board waive the $2,500 campaign finance late fee assessed against Stephen J. "Steve" Windhorst, an unopposed candidate for Judge, Court of Appeal, 5th Circuit, 1st Dist., Sec. 1, Division E, in the November 8, 2022 election, whose 180-P campaign finance disclosure report was filed 92 days late.
Facts:
Stephen J. "Steve" Windhorst request a waiver and states the following: He ran unopposed and was unaware he was required to file the 180-P. When he learned that it was required he filed the 90-P. He then received a letter stating the 180-P needed to be filed and the 90-P needed to be amended. He acknowledges that the reporting requirements were included in the package he received on the day of qualifying. Unfortunately, by then the deadline for the 180-P was 10 weeks past due. He acknowledges that it was his responsibility and obligation to comply with reporting requirements. He would like to request a waiver or reduction of the late fee and/or suspension. Considering the circumstances of my untimely filing my prompt filing of the 180-P and amendment of the 90-P upon being notified and his three-decade history of filing past disclosure reports on time, he believes you may easily conclude that his failure to file timely was not knowingly. His intention has always been full disclosure and compliance.

Notes: The 90-P was timely filed and after reviewing the 90-P report, it was discovered that he had activity that made him required to file a 180-P report. On 8/11/2022, he was sent notice to amend the 90-P and file the 180-P.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
