Advisory opinion request regarding whether the post-employment provisions in the Code of Governmental Ethics ("Code") prohibit the appointment of former Calcasieu Parish School Board member Mack Dellafosse to the Environmental Facilities and Community Development Authority.
Facts:
Mack Dellafosse served as an elected District 7 Calcasieu Parish School Board member from 2007 to 2022. Mr. Dellafosse's term on the school board ended December 31, 2022. Mr. Dellafosse was appointed by the School Board to serve on the Environmental Facilities and Community Development Authority (Authority) for the last 9 years. His term on the Authority ends April 13, 2023. The School Board stated that the person appointed does not have to be one of its members.

On December 13, 2022, subject to the opinion of the Board of Ethics, at the Calcasieu Parish School Board meeting the Board approved a resolution appointing Mack Dellafosse to serve as the Director of the Authority for a period of two years.

Law:
La. R.S. 42:1121.A (2) No former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.


La. R.S. 42:1121.B.(1) General rule for other public employees. No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.

Recommendations:
