Mr. and Mrs. Waits are currently Extension Agents (4-H) for the AgCenter in the Vermilion Cooperative Extension Office. They have both been employed since May of 1992. The Parish Chair for Vermilion Parish is retiring and the AgCenter Administration wishes to appoint Mr. Waits as the new Parish Chair. To avoid any potential violation of La. R. S. 42: 1112, the AgCenter has plans to implement the following disqualification plan: Mr. Waits is prohibited from participating in any decisions regarding leave requests/ approvals, performance evaluations, disciplinary actions, pay increases, promotions, demotions, or any other activity which pertains to Ms. Waits' employment with the AgCenter. Any decisions or activity regarding Ms. Waits that are normally performed by the Parish Chair will be assigned to the Regional Director for the Southwest Region, which is currently Dr. Kurt Guidry.

La. R.S. 42:1112(B)(1) states that no public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any member of his immediate family has a substantial economic interest.
La. R.S. 42:1119C(2) provides that the provisions of this Section shall not prohibit the continued employment of any public employee nor shall it be construed to hinder, alter, or in any way affect normal promotional advancements for such public employee where a member of public employee's immediate family becomes the agency head of such public employee's agency, provided that such public employee has been employed in the agency for a period of at least one year prior to the member of the public employee's immediate family becoming the agency head.
