Waiver request submitted by Alidore Leon "Al" Marmande, Terrebonne Parish Council / District 7 / Terrebonne, regarding a $200 late fee assessed for filing his amended 2020 Tier 2 annual pfd 2 days late.
Facts:
Jade Hebert, who works for Joan Toups Accounting and Tax Service, is submitting a waiver request on behalf of Mr. Alidore Leon "Al" Marmande. Typically, Mr. Marmande forwards his received notices to the accounting firm to complete his necessary paperwork and every year there seems to be a discrepancy. For 2020, they completed the Tier 2.1 PFD, but they were advised to complete the Tier 2 PFD. In 2021, the Tier 2.1 PFD was completed and again they were advised to complete the Tier 2 PFD. On 4/8/22, a BOE representative advised that the 2021 Tier 2.1 PFD be amended, along with the 2020 Tier 2 PFD. The documents were amended and uploaded that same day. Ms. Hebert is requesting a waiver since this would be the 1st time sending in a late annual report and he states the disclosures are usually forwarded on the date the notice is receive. Ms. Hebert is asking that the waiver be considered based on the effort to submit documentation immediately after being notified.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
