Waiver request submitted by John Robert "Bobby" Cortez, former member of the Tangipahoa Parish Council / District 10, regarding a $300 late fee assessed for filing his amended 2020 Tier 2 annual pfd 3 days late.
Facts:
In his 24 years of serving on the Tangipahoa Parish Council, John R. "Bobby" Cortez states that he has always tried to follow ethical rules to the best of his ability. In the spring of 2020, he filed his 2019 Final Report and assumed that he completed the filing process. However, due to the way newly elected officials take office, he served an additional 13 days in January 2020. He contacted a Louisiana Board of Ethics representative and was notified that since he was still in office until 1/13/2020, he would need to file a report. He immediately filed the final report after being notified. Mr. Cortez believed he no longer had to file any additional disclosures and for that reason, he would like to ask that the fee be waived.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 of the Code provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
