Waiver request submitted by Julie Ann Anderson Lively, former member of the Crab Task Force, regarding a $500 late fee assessed for filing her 2020 Tier 2.1 annual pfd 10 days late.
Facts:
Julie A. Lively would like to request a waiver of her assessed late fee for several reasons. Initially, she believed her 2020 statement had been filed until she received a delinquency notice. Due to the notice arriving at the central LSU campus mail system, she did not receive the notice until 4/15/2022. She does not know who initially received it or when it was delivered. Ms. Lively says that neither of the last two letters has a signature to show who received them and they were never delivered to her personally. Once she was made aware, she uploaded the 2020 and 2021 disclosures and updated her address to avoid further issues. She also notified the board via email to let them know she received the notification late. After receiving an email (attached) from BOE she believed the filing process was complete. Ms. Lively feels that she should not be expected to pay a fine since the notice was not delivered to her.

La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
