Waiver request submitted by Betsy Mullins, Oak Ridge Aldermen (pop. 124) / Morehouse Parish, regarding a $25 late fee assessed for filing her 2020 Tier 3 annual pfd 1 day late.
Facts:
Betsy Mullins was sworn in 01/2021 and says "technically" she was not holding any office. However, she was notified by a BOE representative that a disclosure deadline had been pushed back due to Covid. She believed they were just delaying the 2020 statements since she had to file another statement for 5 months in 2021. Ms. Mullins states that although the notice was sent via certified mail, the post office placed it in her P.O. Box with no required signature. She was on vacation from 3/13/2021-03/18/2021 and did not check her mail until 3/19/2022.This statement was late being returned to BOE on 3/24/2022 but was not accepted. Ms. Mullins feels it is her civic duty to help the board, but it is voluntary and she only receives $2 monthly to offset her qualifying fees. She is not working and her spouse is retired. In addition to having limited income, her only son passed away and it has been extremely stressful. She is asking to have the assessed fee waived.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
