Waiver request submitted by David Randal "Randy" Wagley, St. Landry Parish School Board / District 9, regarding a $100 late fee assessed for filing his amended 2020 Tier 2 annual pfd 1 day late.
Facts:
David Randall "Randy" Wagley states he filed the report timely, but neglected to complete two required fields and there was an issue with the BOE receiving the original submission. When he was notified of said issue, the form was immediately resubmitted, but he still did not realize the form was incomplete. On 3/14/2022, he received a delinquency notice while in the middle of a hectic work week. Mr. Wagley states that he is a felony prosecutor and March is a "criminal month" for him in which he handles 45-50 felony matters. He missed work from 3/8/2022-3/9/2022 which caused him to be behind on work tasks when he returned. Mr. Wagley also had court from 3/14/2022-3/17/2022. He has been a member of the St. Landry Parish School Board for 10 years, and to his knowledge, this is his only late filing. For these reasons, Mr. Wagley is asking to have the fee waived.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
