Waiver request submitted by Joseph S. Pappalardo, Jr., Real Estate, regarding a $800 late fee assessed for filing his 2020 Tier 2.1 annual pfd 16 days late.
Facts:
Joseph S. Pappalardo says he cannot dispute the fact that he was 16 days late filing his disclosure, but he would like to ask the board to consider a one-time waiver based on reasonableness. His basis for the request is that he was newly appointed to the Louisiana Real Estate Commission (LREC) on 7/18/2020 at the beginning of a pandemic. Mr. Pappalardo notes that he never held public office before nor had he been a member of the public board or commission. He received the 1st letter but assumed it did not apply to him, since he is a Real Estate Commissioner. He planned to ask a fellow commissioner about the letter, but the LREC did not meet regularly (due to the pandemic) and the letter was overlooked. Mr. Pappalardo contacted BOE about the letter, but he became ill shortly after and missed the deadline. Going forward he plans to file his disclosures on time.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
