Untimely waiver request submitted by Treva Askey, former member of the Workforce Development Board, Seventh Planning District Consortium / Area #70, regarding a $350 late fee assessed for filing her amended 2019 Tier 2.1 annual pfd 7 days late.
Facts:
Treva Askey volunteered with the Board for a few years and moved from Louisiana to her home state Texas in December 2021. She moved so she could care for her mother, who has Dementia, and her brother who has had many strokes and is losing his eyesight. Her mail was forwarded from her old LA address to her TX address. Recently, she moved to a different TX address and during the move, she packed her mail. While unpacking she found the notice which caused her to submit her waiver request 1 day late. She also notes that she is apologetic about the fact her disclosure submission was 7 days late. Ms. Askey is currently financially assisting her mother and brother and the move has contributed to financial hardship for her family. Ms. Askey sincerely apologizes for filing late and would like to ask for consideration in waiving the fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Consider the untimely waiver.

Suspend all based on future compliance with the Code of Ethics.
