Waiver request submitted by Barbara Crain Major, Orleans Parish School Board - Robert Russa Moton Charter School, regarding a $600 late fee assessed for filing her 2022 School Board Disclosure 12 days late.
Facts:
Board Consultant, Roslyn J. Smith, is submitting a waiver request on behalf of Barbara Crain-Major. In early September, Ms. Smith hand-delivered Ms. Crain-Major's disclosure form to the Moton Charter School Office, where her sister is currently employed. Since L'Tanya Randolph Bruno, the school's business manager was absent, Ms. Smith instructed the secretary to fax the disclosure and leave the documents and confirmation receipt on Ms. Bruno's desk. Weeks later Ms. Bruno returned the disclosures to Ms. Smith, but due to miscommunication, the disclosures were never faxed. Ms. Crain-Major was notified numerous times that her form was late, but Ms. Smith assured her that it had been submitted. When Ms. Smith attempted to track the delivered disclosure, she was unable to find confirmation of delivery and the secretary no longer worked for the charter school. Ms. Crain-Major then submitted the disclosure after the deadline. She is asking for consideration due to the circumstances and would like to have the fee waived.

Law:
La. R.S. 42:1119B(2)(a)(iii) by September fifteenth of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement under this Item may be assessed a late fee of fifty dollars per day, not to exceed one thousand five hundred dollars, subject to the provisions of R.S. 42:1157.
Recommendations:
Waive all but $300 of the late fee.
