RE:
Request that the Board waive the $700 campaign finance late fee assessed against Keith C. Bodin, an unsuccessful candidate for Public Service Commission, District 4, in the November 8, 2022 election, whose 10-G campaign finance disclosure report was filed 7 days late.
Facts:
Keith C. Bodin requests a waiver and states the following: After reading the notice, he believed that if he didn't spend any funds on his campaign after 10/19/2022, he was not required to file. He later received the late filing notice dated 12/5/2022 on 12/7/2022. Mr. Bodin states that this was his first time running for public office and he intended to follow all guidelines. He ran the campaign 100% out of his own finances and feels the penalty of this oversight is excessive. He spent a total of $4,096 and the $700 is about 17% of his campaign money spent. Mr. Bodin feels this was an honest mistake and would like to ask for a waiver of the fee.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
